White House Finishes Reviewing EEOC Reporting

The Office of Management of Budget (OMB) has completed the review of the Equal Employment Opportunity Commission’s (EEOC) proposed rule titled, “Recission of EEO-1, EEO-2, EEO-3, EEO-4, EEO-5, and Reporting Requirements under Title VII, the ADA, GINA, and the PWFA.”

Call back: The EEOC submitted the proposed rule for preliminary review on May 14, 2026. The text of the full rule is not yet available; however, we expect the rule to eliminate the reporting requirement of key disclosures on the race, sex, and national origin of the workforce.

Next steps: We expect the proposed rule will be published shortly in the Federal Register with an official Notice of Proposed Rulemaking, opening a public comment period for stakeholders to weigh in.
